Sports and the Law takes the approach that the subject of sports law raises some of the most fascinating and complex questions about how law influences and shapes sports institutions. Using this approach to teach the course makes it enlightening, challenging, and exciting.

Sports and the Law focusses on how this highly visible, popular, and uniquely structured industry is affected by many substantive legal areas - constitutional law, contracts, torts, criminal law, antitrust, labor law, communications law, intellectual property, administrative law, tax, association law, and others. The difficulty of studying sports law becomes clear, however, when legal principles that were created to apply to traditional industries and relationships are raised in the context of this strange and nontraditional industry.

The first seven chapters look at various aspects of professional sports, starting in chapter one with the unique office of the league commissioner. Chapters two, three, and four then analyze the many contract, antitrust, and labor law dimensions of the player-labor market, followed in chapter five by a look at the peculiar institution of the player agent in an unionized industry. That is followed in chapter six by an analysis of how antitrust and other substantive areas affect the structural and franchising decisions of leagues. Finally, chapter seven studies the problem of market power and monopolization in professional sports.

The last four chapters turn to problems facing amateur and individual sports. Chapters eight and nine study the system of college athletics governed by the NCAA. Chapter ten looks at how law impacts individual sports like golf, tennis, boxing, and the motor sports, as well as the structure and operation of international Olympic sports. Finally, chapter eleven focusses on the tort and criminal law issues arising out of the inevitable personal injuries that sports competition causes.
